Labour Market Impact Assessment

Are you looking for employment opportunities in Canada? The first step is to find a local employer with a Labour Market Impact Assessment (LMIA).

Canada’s Temporary Foreign Worker Program (TFWP) supplements the workforce when no locally qualified workers are available. Employers seeking to hire foreign workers must present a Labour Market Impact Assessment (LMIA) to Employment and Social Development Canada (ESDC).

The LMIA must show that hiring foreign workers will have a positive or no effect on the Canadian labour market and that no qualified Canadians were overlooked.

The LMIA process varies based on whether the worker is classified as high-wage or low-wage. Employers are sometimes inspected for compliance after the employee is hired.

Why Labour Market Impact Assessment

An LMIA is a document that Canadian employers must apply for before employing a foreign worker. While some foreign workers may be exempt from needing an LMIA or a work permit, most Canada’s Temporary Foreign Worker Program (TFWP) streams require employers to obtain an LMIA to hire from outside Canada. The worker must receive a salary and benefits meeting federal and provincial standards.

Many immigration pathways to permanent residency in Canada require aspirants to present a positive LMIA to earn points for a Canadian job offer.

ESDC considers several factors while issuing an LMIA, such as:

LMIA VALIDITY & EMPLOYMENT DURATION

After a positive LMIA is issued, the temporary foreign worker can use it for six months to apply for a work permit. No extensions are granted. If the period expires without a work permit application, a new LMIA application is needed.

The LMIA’s validity is different from the duration of employment. Validity indicates the time to apply for a work permit, while duration indicates how long the work permit is valid.
